Apartment Definition in West Bengal Apartment ownership Act 1972

The West Bengal Apartment ownership Act was enacted by the State legislature of West Bengal and the same was sent by Governor of West Bengal to the President of India for his Assent to make the bill an Act. The Act was published in the Calcutta Gazette on 5^th July 1972.

The definition of Apartment is mentioned in section 2(a) of West Bengal Apartment ownership Act 1972.

According to the definition, an Apartment means a part of a property having a direct exit to a road, street or Highway or to a common area leading to such road, street or Highway which together with its undivided interest in the common areas and facilities forms an independent residential unit and includes a flat.

Essential features of an Apartment:

1. It is a part of a property

2. It has a direct exit to a road, street or Highway or to a common area that leads to a road, street or Highway

3. In an apartment there exists an undivided interest in common areas and facilities

4. An apartment also includes a flat.
