How to remove car bike hypothecation Hire purchase agreement from RTO

Every Indian has the craze to ride a Car/Bike because it gives you the freedom to visit  any public place within the territory of India at your sweet will. Some people buy from their own money and some others buy car/bike with the help of financier. If you buy car from your own money , from day one of buying the car/bike you become the owner of the car/bike but in case of buying car/bike from the financier you are the possessor but not the pure owner. You become the owner when you pay the final premium. Remember that after paying the final premium the car/bike does not automatically becomes yours. You need to remove the hypothecation details from the RTO.  

                     The H.P.T(Hypothecation Termination)/ removal process is very easy but little time consuming. In this article we have given you complete details to remove hypothecation from your car/bike. Documents and others required:

(a) Note Sheet ( a particular form provided by RTO)

(b) Vehicle registration blue book (Original)

(c) NOC (No Objection Certificate) from finance provider

(d) Two parts of form 35

(e) Car or Bike insurance certificate (Xerox copy)

(f) PUC (Pollution Under  Control) certificate

Process to remove Hypothecation from your car/two wheeler

Removing hypothecation from your car/bike is a very challenging but not very difficult task.  For your understanding I will segment this process into two parts

1. Obtaining NOC from Finance

2. Submit NOC, form 35 and other required documents to RTO.

1. Obtaining NOC from Finance:

After paying your last car/bike premium, you do not become automatically the owner of the car. You have to remove Hypothecation from your car/ bike. Mostly after the completion of final car/two wheeler premium the finance company call you to receive the NOC and form 35. If you did not get any such then you need to contact the person / office from where you got the finance approval . when the office receives such  NOC , they will call you to collect such from them. The NOC certificate is valid upto 90days from the date of issuing. Suppose NOC for your car is issued on 2/11/2018 then you need to submit to RTO within 90 i.e. before 25/02/2019.  

                            

2. Submitting NOC and Other required documents to RTO

Visit the RTO from where your car / two wheeler got registered initially. Visit there with all the required documents mentioned above. Fill up the Note Sheet with proper care. Keep the note sheet  at the top of all documents and keep them in a cover file(see the picture). In the front side of the cover file write down  1 Car/bike registration number 2 HPT(i.e. Hypothecation Termination) 3 Name of Car/Bike owner 4 Mobile number

Now visit to HPT form receiving counter , here they will entry your car/bike number and sign in the Note Sheet. After that you have to go to ARTO for approval. After getting the approval you have to go to Non Technical section where they will collect your form. They may also tell you that you have to go to your finance provider and finance company to write in Form 35(both parts) “Hypothecation termination confirm” and signature of the authorized person with stamp and date. After completing this process then again visit to the RTO office non technical section and now they will take your application. They will give you a time and after that time you have to again come to RTO office and have to collect new blue book.    

After visiting non technical section(first floor: Barasat RTO) , they will tell you to pay rs 130/- in ground floor cash counter. after that you have to verify your car/bike insurance from ground floor counter. then you have to visit ARTO and then visit non technical section. now submit your application before 3pm. You will receive your RC on the same day of submission within one hour. 

[N.B: This step by step Hypothecation termination/removal process is mostly suitable for West Bengal, Barasat RTO. Documents required in each state within the territory of India is same]

Note Sheet:

In documents required section you may have seen Note Sheet term. This is basically a form which you will find at RTO office(If you wish you can buy from outside agents too but not recommended). This Note Sheet actually collect informations like vehicle owner’s name, vehicle number, your address, mobile number, validation period of your car registration, chassis number, engine number, NOC issued from which state, Car/Bike insurance certificate number, hypothecation termination date, pollution Under Control certificate valid upto, address proof etc. if you need a sample filled up Note Sheet then request in the comment section.
